DEC Fishing Access Site Agreement

Re: Fishing access rights on Park Settlement Road/Owego Creek

Dear Mr. Riggs:

I would like to confirm the agreement between the Town of Candor, NY (Town) and the New York State Department of Environmental Conservation (NYSDEC).   Owego Creek in the Town is a popular fishing area, and NYSDEC recently acquired public fishing rights along portions of the creek.   Both the Town and the NYSDEC wish to preserve and enhance fishing access sites on Owego Creek for the general public.

There is a previously constructed angler parking area on Park Settlement Road in the Town of Candor (parking area). This area is located on the Northwest corner of the junction of Park Settlement Road and Owego Creek.

The Town and NYSDEC agree as follows:

1)  NYSDEC shall maintain a FAS at the Park Settlement Road bridge location to provide angler parking for 6 to 8 vehicles.

2) The Town shall retain its existing rights to access Owego Creek from the parking area.  

3) NYSDEC shall do normal routine maintenance at the parking area, including litter pick up, surface work, and the erection and upkeep of standard NYSDEC Fishing Access Site signage. The main NYSDEC Facility Identification sign shall include the wording “Owego Creek Fishing Access Site – New York State Department of Environmental Conservation in Cooperation with the Town of Candor”.

4) The Town and NYSDEC shall cooperate in the administration of the parking area for the general benefit of the People of the State of New York.

5) Other than the performing the obligations set forth in this letter, neither the Town nor NYSDEC shall be required to complete any additional improvements or maintenance at the parking area.

6) The agreement set forth in this letter can be terminated by either the Town or NYSDEC at any time upon written notice to the other party.
